MS Real Estate Commission proposes rule changes to advertising and teams

President David Griffith and his Executive Committee want to let all Mississippi REALTORS® know that on August 1, 2017, the Mississippi Real Estate Commission filed proposed amended rules for Advertising and proposed new rules for Teams with the Secretary of State’s office. A copy of the filings is here.

These proposed rules and changes will be going through the filing process with the Secretary of State and will be presented to the MREC Commissioners for Final Action as early as their September meeting. Following approval by the commissioners at that meeting, implementation of the Final Rules can be expected in the next few months.

In accordance with the APA (Administrative Procedures Act), members have the right to submit comments on the proposed rules to the MREC or request a public hearing on the matter. Any person or persons wishing to request a public hearing must file a written request with the MREC within 20 days of the date of the administrative filing, which was August 1, 2017. When a total of 10 or more people request a public hearing, MREC is required by the APA to schedule and conduct a public hearing prior to adopting the rule.

A copy of the proposed changes is here. Members need to be aware that the proposed advertising rules apply to ALL licensees, not just to Teams, and impact all of your advertising materials, including business cards, signs, social media, etc.

Please carefully read the rules and be working over the next several months to bring your advertising materials and business models into compliance.
